Late payment of an administrative fine in the amount of 400 thousand rubles for violation of the conditions stipulated by the license for the use of mineral resources, led to another fine.

In 2021, an organization carrying out sand mining activities in the village of Sabanchi, Almetyevsk district, violated the requirements of a license for the use of mineral resources, for which she was brought to justice by inspectors of the South-Eastern TA Ministry. A protocol was drawn up under part 2 of art.7.3 of the Administrative Code of the Russian Federation and a fine of 400 thousand rubles was imposed. The legal entity had to pay it in full no later than 60 days from the date of entry into force of the resolution. However, the company applied for a delay in the payment of the fine for 1 month and an installment payment for 3 months. However, according to the approved schedule, the payment was not received on time.  In this connection, an administrative protocol was drawn up under Part 1 of Article 20.25 of the Administrative Code of the Russian Federation "Evasion from execution of administrative punishment". The case was transferred to the magistrate of the Vakhitovsky district of Kazan. The judge, having considered the case, ordered the violator to pay in addition to the main fine another one - in the amount of 800 thousand rubles. But even here the guilty person, not agreeing with such a decision, made a petition and appealed to the Vakhitovsky district Court of Kazan. The court decided to change the size of the punishment and reduce it to 400 thousand rubles.

As of today, the company will have to pay a fine of 400 thousand rubles according to Part 2 of art.7.3 of the Administrative Code of the Russian Federation, and 400 thousand rubles under Part 1 of Article 20.25 of the Administrative Code of the Russian Federation.
