“Spetsgidrostroy” still be punished. Decision of 11-th Arbitration Court of Appeal cancelled in favor of environmentalists

The cancellation of the decision of the 11-th Arbitration Court of Appeal ended the case of the Arbitration Court of the Volga District. Back in August, inspectors of the Ministry of Ecology discovered a violation in the city of Almetyevsk. At the entrance to the pond near the Stepnoi Zai river, ZAO “Spetsgidrostroy” installed a fence from the corrugated board and filled the shore with earth. On-site worked heavy equipment: excavator, tractor, and truck KAMAZ. On the opposite side of the pond, a pit was dug. The excavated land was exported to cover the shore. For violation of the special regime for carrying out activities on the coastal protective strip of the water body, ZAO Spetsgidrostroy was brought to responsibility for part 1 of Article 8.42 of the Code of Administrative Offenses of the Russian Federation. The fine was 200 thousand rubles. But the offender did not agree with the decision of the inspectors of the South-Eastern Territorial Administration of the Ministry of Ecology and Natural Resources of the Republic of Tatarsta and appealed to the 11-th Arbitration Appeal Court. In turn, the Ministry of Ecology appealed to the Arbitration Court of the Volga region with a cassation appeal, which cancelled the decision of the 11-th Arbitration Appeal Court.
