“Residential house on water conservation zone – to be demolished”. Supreme Court upheld decision of Ministry of Ecology.
Residential house on the bank of riverStepnoyZai in Almetyevskmust be demolished. This judgment was delivered by the Supreme Court of the Republic of Tatarstan.
Measures to eliminate the violations identified in the framework of the Year of the water protection zonesare carried out in Tatarstan. In the summer of 2016 inspectors of the Southeast Territorial Administration of the Ministry of Ecology of Tatarstan issued an order to demolish the illegal construction. The breach was discovered duringinspection carried out by the Ministry of Ecology inspectors and specialists of the Tatar interdistrict environmental prosecutor’s office. The house is built in 6.5 meters from the shoreline, and its fence is in 6 m from the river. According to Art. 6 of the Water Code of the Russian Federation, 20-meter strip of land along the shoreline of a water body should be provided for public use. Environmentalists drew up a report against the owner in acc. with Art.8.12.1 of the Administrative Code (“Failure to comply with the conditions of providing free access to the publicwater body and its foreshore”). The violation was not eliminated in due time, and in this connection the experts of the Southeast TA filed a lawsuit toAlmetyevsk municipal court, which also recognized the actions of theAlmetyevskcitizen as illegal. The owner appealed the decision to the Supreme Court. The court ordered the owner of the house to provide unhindered access of people to the water body by removal (demolition) of the structures built within 20 meters of shoreline of a water body.
In 2016 specialists of the Ministry of Ecology and Natural Resources of the Republic of Tatarstan accumulated experience in identification and elimination of violations related to water protection zones. Significant attention is paid to the establishment of the boundaries of water protection zones and coastal protection zones of water bodies.
