In the course of inspection of the coastal area of the Shilna River in Tukaevo district, inspectors of the Cis-Kama Territorial Department under the Ministry of Ecology and Natural Resources of the Republic of Tatarstan detected an illegal construction. The summerhouse “Fisherman’s house” was hanging over the river at the coastal protection area.Head ofMalaya Shilna rural settlement received an instruction to demolish the illegal construction. The deadline for completion expired in January 2016. Experts of the Cis-Kama Territorial Department lodged a claim to Tukaevo district court to compelMalaya Shilna rural settlement to ensure free access of citizens to the water body by demolition of the construction and its removal out of the boundaries of the 20-m coastal area of the water body. Adjudication of the claim is scheduled for March 30, 2016.
Similar cases were also revealed last year. In the course of the ecological monitoring of Malaya Shilna rural settlement of Tukaevo municipal district, an administrative offence was revealed on the part of two land plot owners on Gagarina str. in the water protection area of the Shilna River. Land plot owners restricted the access of citizens to the public water body by placing a dead fence up to the river line – thus, the rights of the citizens for the favorable environment guaranteed by Article 42 of the Constitution of the Russian Federation was violated.Protocols were drawn up against the land plot owners in compliance with Article 8.12.1 of the Administrative Code of the Russian Federation–Failure to comply with the obligation to provide citizens with free access to the public water body and its coastal area, and a mandatory instructionwas issued to implement corrective actions. The access tothe water body was ensured, and the fences were removed in compliance with the instruction.
As a reminder, by order of the Minister of Ecology and Natural Resources of the Republic of Tatarstan, Farid Abdulganiev, the work of inspectors of the Ministry with regard to revelation of offences related to restriction of the access to the water body has been enhanced.
