Tukaevo District Court of the Republic of Tatarstan passed a sentence with regard to the criminal case against an entrepreneurfrom Tukaevo district, Elagudzha Dilebashvili.He was found guilty of committing a crime envisaged by part3 of Article 291 of the Criminal Code of the Russian Federation (official bribery for knowingly illegal actions). It was established by the Court that in July2015 during ecological monitoring of the territory of Tatarstan village (Tukaevo district), an inspector of the Cis-Kama Department revealed the fact of a glaring violationon the part of the entrepreneur. The latter, in contempt of all the rules of safe recovery of hazardous substances, simply dropped crushed glass fromluminescent lamps on to the ground. The offences of this kind fall within the administrative ambit of Article8.2 of the Administrative Code of the Russian Federation “Failure to comply with ecological and sanitary & epidemiological requirements to the management of production and consumption waste, the substances destroying the ozone layer, as well as other hazardous substances”. The inspector drew up a protocol on the administrative offence, following the results whereof it was decided to inflict administrative punishment in the form of a fine in the amount of 100 thousand rubles. The entrepreneur decided to avoid the fine by attempting to bribe the official, and he had no luck. The Inspector of the Cis-Kama Territorial Department under the Ministry of Ecology and Natural Resources of the Republic of Tatarstan refused to take the bribe, and a criminal case was initiated againstthe briber. As for now, besides the fine imposed for the failure to comply with ecological requirements, the entrepreneur Elagudzha Dilebashvili will have to pay another fine in the amount of162 thousand rubles according to part 3 of Article 291 of the Criminal Code of the Russian Federation.
As a reminder, earlier, following the results of the inspection carried out by Kazan Interdistrict Nature Protection Prosecutor’s Office under Volga Interregional Nature Protection Prosecutor’s Office, an administrative case was initiated according to part 1 of Article 19.28 of the Administrative Code of the Russian Federation “Illegal remuneration received from a legal entity”. By the ruling of the Nature Protection Prosecutor, the Justice of Peace held the entrepreneur from Tukaevo administratively liable for the official bribery in the amount of one million rubles.
