Judicial Board of the Supreme Court of the Republic of Tatarstan reviewed a criminal case regarding bitumen spill in Derbyshki by appeal of the convicted

On February 24, 2015 the CriminalJudicialBoardoftheSupremeCourtoftheRepublicofTatarstanreviewed the criminal case upon appeal of convicted Diana Nurgalieva in the course of an open court hearing.

Directoroftherealestateagency “InvestRealt”DianaNurgalievawasfoundguiltyin pollution of ground with hazardous products of economic activity, namely in spill of bitumen in the forestland of Derbyshki village of Sovetsky district of Kazan in the amount of more than 2 thousand tons. Violation of nature protection legislation was revealed by inspectors of the Ministry of Ecology and Natural Resources of the Republic of Tatarstan in April 2013. Theviolationentailedinfliction of harm on the environment anddamage of forest vegetation.

The Ministry of Ecology organized cleaning and removal of bitumen. InOctober 2013 themeasuresonbiologicalreclamationoftheterritorywereimplementedbyeffortsoffellow workers of the Ministry of Ecology and Natural Resources of the Republic of Tatarstan, proponents of ecological public organizations, students ofKazan (Volga) Federal University, Kazan State Agricultural University, Kazan National Research Technical University named after A.N.Tupolev - KAI (KNRTU-KAI), citizens of Derbyshki village, summer residents of a horticultural society “Medik”, and journalists. Hard-to-reachplaceswerecleanedfrombitumen, andabout 1,200 seedlings of pines, mountain ashes and birches were planted.

In her appeal, Nurgalieva asked for deliverance from a charge and cancellation of the court ruling as of March 14 and July 8, 2014 and dismissal of criminal proceedingsunder part 1 Article 171 of the Criminal Code of the Russian Federation. The Criminal Judicial Board of the Supreme Court of the Republic of Tatarstan decided to leave the sentence of the Court of Sovetsky District of Kazan as of December 15, 2014, as well as rulings as of March 14 and July 8, 2014 of the same court unchanged. The court ruling as of December 15, 2014 against D.I. Nurgalieva was amended, i.e.the operative part of the sentence was supplemented with indication of recognition of her right for rehabilitation under part 1 Article 171 of the Criminal Code of the Russian Federation.

Evgeny Pavlov and Bulat Nurtdinov were convicted under the same articles.  Itwasdecidedtocollectthefollowingamounts jointly and severally from Nurgalieva, Pavlov and Nurtdinovin consideration for indemnification for financial damage caused by the indicated crimes in favor of:

-       StatePublicEstablishment “Prigorodnoeforestry” — for ground pollution in the amount of 3,187,243 rubles, and for forest vegetation damage4,146 rubles;

-       the Ministry of Land and Property Regulations of the Republic of Tatarstan — in the amount of 1,092,000 rubles;

-       Executive Committee of Municipal Formation of Kazan — 50,451 rubles.
