The Supreme Court of Tatarstan sided with environmentalists in the case of illegal allocation of land

The Supreme Court of the Republic of Tatarstan supported the demands of environmentalists of the South-Eastern Territorial Administration of the Ministry of Ecology to recognize the ownership of a land plot as illegal and left the decision of the Bugulma City Court unchanged.

Let us recall, that according to a complaint received about the restriction of free access of residents to ponds in the village of Klyuchevka of Bugulma district, ecologists carried out a field visit, during which the fact of environmental violations was confirmed. A sign restricting access to water was illegally installed on the shore of the reservoir. As it turned out, the land plot on which the ponds are located was transferred to the ownership of a local resident, which contradicts the current legislation, since the ponds located on the land plot are located on a tributary of the Tumbarlinka river.

In accordance with Article 102 of the Land Code of the Russian Federation No. 136-FZ dated 25.10.2001, the lands of the water fund are the lands on which surface water bodies are located, and in accordance with Article 27 of the same Code, the privatization of land plots within the coastal strip established in accordance with the Water Code is prohibited.

In this regard, the South-Eastern TA appealed to the Bugulma City Court with a demand to recognize the illegal ownership of the land plot. The ecologists' claims were satisfied by the judicial authority.

However, the owner of the plot did not agree with the decision of the Bugulma City Court and appealed to the Supreme Court of the Republic of Tatarstan. The court upheld the decision of the Bugulma City Court. The environmentalists' claim is satisfied.
