Russian Ministry of Natural Resources developed new Rules for calculation and charging for negative impact on the environment

The corresponding draft regulation of the RF Government “On establishing the Rules for calculating and charging for negative impacts on the environment, control the correctness of its calculation, completeness and timeliness of its submission”, has been submitted to the Government of Russiaby the letter of Sergey Donskoy,the Ministry of Russia’sMinistry of Natural Resources, as announced on the official website of the Ministry of Natural Resources and Ecology of the Russian Federation. Adoption of the draft regulation will ensure uniform and reasonable calculation and charging for negative impact on the environment, both for economic entities and territorial authorities of the RosPrirodNadzor. New rules have been brought in line with earlier changes in environmental legislation aimed at implementing the best available technologies, as well as amendments to the Law “On the Production and Consumption Waste”. According to the draft Regulation,all legal entities and individual entrepreneurs will be chargedcountrywide, with the exception of business entities engaged in economic activity solely on the objects of category IV which have minimal negative impact on the environment. The charge for the negative impact on the environment will not be levied in the following cases: emissions andpollutants discharges within the technological standards after the BATimplementation; production and consumption waste to be accumulatedand actually disposedin the prescribed manner; location of production and consumption waste at sites ensuring the exclusion of negative impact on the environment, determined in accordance with the waste management laws of the Russian Federation. Enterprises-nature users must pay a fee for the negative impact on the environment, the size of which depends on compliance ofthe amount of pollution to the established standards/limits of emissions, discharges, waste disposal limits. Payment base of the fee for a negative impact on the environment is the amount (weight) of pollutants discharged by stationary sources into the environment in form of air emissions, sewage discharges into water bodies, and volume of disposed production and consumption waste for the reporting period. The payment base shall be determined by the payer on the basis of industrial environmental monitoring data. The draft Regulation establishes a number of rules for determining the payment base used in calculating the fee for a negative impact. When calculating the fee for a negative impact on the environment, thecoefficients established by the Federal Law “On Environmental Protection” shall be applied,including those that relate to the territories and objects under special protection in accordance with the legislation of Russian Federation, as well as additional coefficients for calculating the fee for flaring associated gas. The reporting period for the fee for negative impact on the environment is a calendar year, and it must be paid no later than March 1 of the year, following the reporting period. Calculations of the fee for negative impact on the environment must be submitted no later than 10 March of the year, following the reporting period, to the relevant territorial body of theRosPrirodNadzor as part of the declaration of the fee, the procedure of submissionand the form of which are established by the Ministry of Natural Resources of Russia. Correctness of the fee calculation, completeness and timeliness of its inclusion in the budgetary system of the Russian Federation is controlledby RosPrirodNadzor and its territorial bodies.
