According to Federal Law No. 89-FZ "On Production and Consumption Waste", manufacturers and importers are required to organize the disposal of waste generated by the use of their goods and packaging. This applies to both legal entities and individual entrepreneurs producing goods and packaging in Russia, as well as importers who import goods, including packaging, from countries within and outside the Eurasian Economic Union.
The obligation to dispose applies only to goods and packaging included in special lists approved by Decree of the Government of the Russian Federation dated December 29, 2023 No. 2414. These lists contain information about which waste is to be disposed of and which disposal standards apply. If, starting from January 1, 2024, an organization produces or imports goods and packaging from these lists, it is obliged to ensure the disposal of waste from their use.
A report on meeting the requirements of extended producer responsibility must be sent to the Federal Service for Supervision of Natural Resources Management by April 15 of the year following the reporting period.
For reference: Extended Producer Responsibility (EPR) is a mechanism by which manufacturers and importers of goods and packaging are responsible for waste disposal after products lose their consumer properties. Its task is to reduce the burden on the environment, develop recycling and return secondary resources to economic circulation.
